The Foreign Corrupt Practices Act in Latin America
AS/COA will host and event on Foreign Corrupt Practices Act (FCPA) enforcement by the U.S. Department of Justice and the U.S. Securities and Exchange Commission.
Overview
Over the past several years, the U.S. Department of Justice and the U.S. Securities and Exchange Commission have stepped up their enforcement of the Foreign Corrupt Practices Act, or FCPA. These regulations, as well as the U.K. Bribery Act 2010, bind all corporations and individuals in commercial dealings to keep transparent accounting documentation and refrain from bribery of foreign officials. International corporations are thus increasingly engaging in anti-bribery due diligence and investigations across the globe. This program will focus on FCPA compliance in Latin America and specific risk factors:
- What risk factors make companies conducting business in Latin America more vulnerable to possible FCPA violations?
- What types of conduct have triggered investigations into potential FCPA violations?
- What lessons can be learned from recent enforcement efforts aimed at companies doing business in Latin America?
- What are the best practices to develop and implement effective anti-corruption compliance programs and due diligence efforts?
Panelists:
- Frank Holder, Chairman of Latin America, FTI Consulting
- Joan E. Meyer, Partner, Baker & McKenzie LLP
- Thomas O’Brien, Partner, Litigation Department, Paul Hastings
- Christopher Sabatini, Senior Director of Policy, Americas Society/Council of the Americas; Editor-In-Chief, Americas Quarterly (Moderator)
